What this notice covers
This notice explains how we use personal information when you visit our website, submit an enquiry, or contact us by email or telephone about our services, ownership opportunities, visiting the yard, or working with us.
If you become a customer or employee, or we need additional information for a particular service or recruitment process, we will provide further privacy information where needed. This notice does not describe every record kept in running a racing yard.
The information we collect
When you use the enquiry form, we collect your name, your email address or telephone number, the reason for your enquiry, and the message you write. The form does not accept file attachments. If you email us directly, we also receive the information and any attachments you choose to send, together with normal email delivery information.
When you telephone us, we may keep relevant correspondence or notes needed to deal with your enquiry. For job enquiries, we may receive information about your experience, qualifications, availability, and any CV you choose to email.
The hosting service also processes technical information when you visit the website. This may include your IP address, the pages requested, dates and times, browser information, the referring page, and errors. Our enquiry service uses an IP-derived identifier and submission timestamps to limit repeated submissions and reduce spam. The temporary rate-limit records do not contain the enquiry message itself. An IP-derived identifier is not treated as guaranteed anonymous information.
Please do not use the general enquiry form to send passwords, payment-card details, identity documents, or unnecessary sensitive information, such as medical information. If such information is genuinely needed later, we will explain how to provide it and why it is required.
Where the information comes from
We receive enquiry and recruitment information directly from you. Technical information is generated when your browser interacts with the website and its hosting service.
If you provide someone else's information, please provide only what is necessary and make sure you are entitled to share it. Where required, we will provide that person with appropriate privacy information.
Why we use your information
We use your information to respond to your enquiry, discuss the services or opportunities you have asked about, arrange requested contact or a yard visit, and keep an appropriate record of our correspondence.
For initial job enquiries, we use the information to assess and respond to your interest in working with us. We will explain any additional checks or use of information separately if you enter a formal recruitment process.
We use technical information to deliver and maintain the website, diagnose errors, protect the website and enquiry service, and prevent abuse. We may also need limited records to comply with a legal obligation or establish, exercise, or defend a legal claim.
Submitting an enquiry does not subscribe you to a newsletter or give us permission to send unrelated promotional emails. We do not sell personal information collected through this website.
Our lawful bases
Under UK data protection law, we need a lawful basis to use personal information.
Enquiries about entering a contract: When you ask us to take steps towards providing a service to you, we use information necessary to take those steps at your request. If we subsequently contract with you, necessary information may also be used to perform that contract.
Other enquiries and correspondence: We rely on our legitimate interests in responding to people who contact the yard, providing relevant information, arranging requested visits, and maintaining proportionate correspondence records. We consider the necessity of that use and its effect on your rights and interests.
Initial job enquiries: Where applicable, we use information to take steps at your request towards a possible employment contract. For other necessary assessment and limited recruitment record-keeping, we rely on our legitimate interests in considering suitable staff and managing recruitment fairly. Any separate use of sensitive information or legally required checks needs an appropriate additional basis and explanation.
Website operation and security: We rely on our legitimate interests in operating a reliable website, identifying faults, and protecting the enquiry service from misuse.
Legal obligations and claims: Where a specific law requires us to retain or disclose information, we rely on compliance with that legal obligation. Where necessary to handle a legal claim, we rely on our legitimate interests in establishing, exercising, or defending that claim, subject to any additional conditions required for sensitive information.
If we ask for consent for a separate purpose, we will explain that purpose when we ask. You may withdraw that consent at any time, without affecting the lawfulness of what was done before withdrawal. We do not treat use of the enquiry form as blanket consent for other purposes.
Who can receive your information
Your enquiry is sent to the yard's mailbox at kerry@kerrylee.co.uk. Kerry and people authorised to assist with the relevant enquiry may access it where necessary.
We use DreamHost to provide website hosting and email services. DreamHost and the service providers it uses may process information needed to host the website, deliver and store email, maintain security, and provide technical support. This does not mean your message is published on the website.
Where necessary, we may disclose relevant information to professional advisers, insurers, courts, or public authorities to obtain advice, comply with a legal requirement, or handle a claim. We do not routinely send an enquiry to other businesses simply because you contacted us.
Processing outside the United Kingdom
DreamHost is a US-based provider. Website and email information may be processed in the United States and other countries where DreamHost or its service providers operate.
DreamHost's customer data-processing terms include standard contractual clauses and the UK International Data Transfer Addendum for relevant transfers that are not covered by an applicable adequacy arrangement. These are contractual safeguards intended to protect personal information when it is processed outside the UK.
You can contact us using the details above to request further information about the safeguards relevant to your information, or a copy of them, subject to appropriate redaction of confidential information.
How long we keep information
Ordinary enquiries that do not become a customer relationship: We normally delete enquiry correspondence within 12 months after our last meaningful contact, unless a continuing enquiry, complaint, or legal issue gives us a justified reason to keep it longer.
Unsuccessful initial job enquiries or applications: We normally delete these records within six months after the recruitment decision or, if no recruitment process takes place, after closing the enquiry. If we wish to retain your details for future opportunities, we will agree a separate, limited retention period with you.
Customer or employment records: Where an enquiry develops into a customer or employment relationship, information needed for that relationship is retained under the relevant record-keeping requirements. We will provide further privacy information where appropriate. Information required for accounting, legal, or regulatory purposes may need to be kept longer than an ordinary enquiry.
Technical and security records: DreamHost states that its HTTP access and error logs are retained for seven days by default. Temporary enquiry rate-limit records are separate from those logs. Our enquiry anti-spam records contain only an IP-derived identifier and recent submission timestamps. Records inactive for 24 hours are scheduled for deletion by an hourly cleanup process, normally within 25 hours of the last recorded submission. If a cleanup run is overdue, the form stops accepting new enquiries until the issue is resolved. We investigate cleanup failures; an interruption can delay deletion. If relevant information is needed to investigate a security incident or handle a claim, it may be retained for the period necessary for that specific purpose.
Deleted information may remain in protected provider backups until those backups are replaced or removed under the provider's retention processes. Backup copies are not used for ordinary correspondence. We do not promise immediate removal from every backup when an active record is deleted.
Cookies and similar technologies
Our website and enquiry form do not set cookies or use browser storage for visitor tracking. Fonts, images, and the website's own scripts are served as part of the site. Our website does not include advertising pixels, third-party analytics scripts, embedded maps, or embedded video players.
If we add services that change this, we will update this notice and provide any legally required choices before using them.
Links to other websites take you to services that operate their own privacy and cookie policies. Their practices apply when you visit them; this notice does not replace those policies.
Keeping information secure
We use appropriate technical and organisational measures to restrict access and protect information. The website uses HTTPS, and the enquiry service uses an authenticated, encrypted connection to the mail provider. Access to enquiries should be limited to people who need it for their work.
No website or email system can guarantee absolute security. Please send only the information necessary for your enquiry. If you believe information has been sent to the wrong person or used improperly, contact us promptly.
Your choices and rights
You do not have to use the enquiry form. You can contact us directly instead. The form requires your name, a valid email address or telephone number, an enquiry reason, and a message so we can process and respond to it. If you do not provide those details, it cannot be submitted successfully.
Depending on the circumstances, you may have rights to:
- request access to your personal information and a copy of it;
- ask us to correct inaccurate or incomplete information;
- ask us to erase information where there is no lawful reason to keep it;
- ask us to restrict certain uses of your information;
- object to processing based on legitimate interests; and
- receive or transfer information in a portable format where the legal conditions apply.
These rights are not absolute, and their availability depends on the purpose and lawful basis for the processing. Where processing relies on consent, you may withdraw that consent. You can also object at any time to use of your information for direct marketing.
To exercise a right, email kerry@kerrylee.co.uk. We may need proportionate information to verify your identity. We normally respond without undue delay and within one calendar month, subject to extensions or pauses permitted by law. If one applies, we will explain it.
We do not use the website enquiry process to make solely automated decisions producing legal or similarly significant effects about you, or to profile you for advertising. Automated spam and rate-limit checks may reject a submission; if this happens, you can email or telephone us directly.
Complaints
If you have a concern about how we use your personal information, please contact kerry@kerrylee.co.uk so we can investigate and respond.
You also have the right to complain to the Information Commissioner's Office (ICO), the UK data protection regulator. Visit ico.org.uk/make-a-complaint for information about making a complaint. You do not have to give up that right while contacting us.
Changes to this notice
We will update this notice if the way we collect or use information changes. The date at the top identifies the latest published version. Where a change needs to be brought to your attention directly, we will do so as appropriate.
